What makes a New Mexico bid different
New Mexico is one of the few states where “which code?” has one answer.
The Construction Industries Division adopts the book for the whole state. Commercial work is the 2021 New Mexico Commercial Building Code. Houses are the 2021 New Mexico Residential Building Code. Energy is the 2021 residential and commercial energy codes, both effective 30 July 2024. Albuquerque, Clovis, Gallup, Carlsbad — same edition. A number that pencils in Rio Rancho still pencils in Roswell.
Right now there’s one moving piece. The 2024 New Mexico Mechanical Code and the 2024 New Mexico Plumbing Code took effect on 1 August 2026, with a transition window where either the old rules or the new ones can be used until 1 January 2027. Electrical is still on the 2020 book. Ask which book the inspector is taking before you price the MEP.
Then there’s the tax, and this is the one that catches out-of-state contractors.
New Mexico doesn’t have a sales tax. It has gross receipts tax, and GRT lands on services — construction services included. It isn’t just buried in your material invoices the way sales tax is in most states. It rides on the contract. The rate is a stack: state, county and city, tied to the location code where the work physically sits, so two jobs forty miles apart are two different rates. Since 1 July 2025 those rates only move once a year, in July.
There is a way out of paying it twice. Section 7-9-52 lets you deduct receipts from construction services sold to another construction business, as long as the buyer hands you a nontaxable transaction certificate and the project itself will be taxed on completion or sale. It also covers work on the tribal territory of an Indian nation, tribe or pueblo — which matters here, because a lot of New Mexico work is on tribal land. If you’re a sub who starts the job before the NTTC shows up, you’re going to carry that tax on your own margin.
And under all of it is the geography. The jobs on this page run from Carlsbad and Clovis on the southeastern plains up to Los Alamos and Santa Fe in the mountains — haul distances, weather windows and sub benches that have nothing in common.
Four things that get missed on a New Mexico construction estimate
Every one of these has cost somebody real money. We see them monthly.
1. GRT as a line, not a footnote. Because gross receipts tax applies to the service, it belongs on the estimate as its own line at the location-code rate for the site, and the NTTC question has to be answered before you sign. Sub work billed to a GC with a certificate is deductible. The same work billed straight to an owner usually isn’t. That difference is your whole fee on a thin job.
2. The prevailing wage trigger and the paperwork behind it. The Public Works Minimum Wage Act kicks in on public work over $60,000 — a low bar, which puts school, county and municipal jobs in scope fast. Workforce Solutions sets the rates and publishes them by 1 October to take effect 1 January, contractors and subs have to be registered with the department before they bid, and certified payroll goes in weekly. Price the rate and price the admin hours to produce the payrolls.
3. The mechanical and plumbing changeover. Between 1 August 2026 and 1 January 2027 both books are live. If you bid a fit-out this month against the older rules and the inspector takes the 2024 code, you’re going to find the difference in venting, fixtures and gas piping after the walls are closed.
4. Two permit numbers, not one. Albuquerque’s posted schedule computes the permit above $320,000 of valuation at $993.75 for the first $100,000 plus $5.60 for every additional $1,000, with a .67 commercial multiplier — and then plan check runs 65% of that permit fee on top. Estimators write the permit and forget the review. On a mid-sized commercial job that’s four figures of General Conditions sitting in nobody’s column.

Four building types, from a $113K restaurant remodel in Santa Fe to a $15.8M office in the Permian. Fourteen of the sixteen are New Mexico jobs. The two custom homes from out of state are here because they show the depth of a high-end residential takeoff — eighteen pages on one of them — and because our New Mexico residential file is houses, not mansions.
Look at the range inside one category. The Curry County Livestock Pavillion is ten pages, concrete and masonry and metals through finishes, a county building priced the way public work has to be priced. The Taco Bell on Cerrillos is three pages of demolition, carpentry, doors and finishes. Same estimating desk, same format, two jobs that share nothing else.
The Dulce and Casa Blanca jobs matter for another reason: housing on tribal land carries its own tax treatment and its own logistics.
Where we work in New Mexico
We estimate statewide. Here’s where the volume actually is.
Albuquerque metro. Albuquerque, Rio Rancho, Bernalillo, Los Lunas and Belen. Six of the sixteen estimates above are metro jobs — a medical fit-out downtown, a restaurant, an interior package, an apartment unit and a custom house in Rio Rancho.
Santa Fe and the north. Santa Fe, Los Alamos, Española and Taos. Hospitality, apartments and retail remodels. Three of the sixteen sit up here.
Northwest and the Navajo Nation. Gallup, Farmington, Shiprock, Navajo, Dulce and Casa Blanca. Hotel work, housing programs and school facilities, much of it on tribal land where the 7-9-52 rules apply.
Southeast and the Permian. Carlsbad, Hobbs, Artesia, Roswell, Clovis and Portales. Oil-patch offices and county buildings. Long hauls, thin sub markets, and the biggest single estimate on this page.
Southwest. Las Cruces, Deming, Alamogordo and Silver City. Retail, restaurant and light commercial.

New Mexico added construction jobs faster than any other state between May and June 2026 — 3.2%, about 1,700 jobs, per AGC. That’s a small market moving quickly, and it means the shops that can turn bids around are the ones picking up the work.
